Judge Freezes Millions in Alberta Separatist Lawyer's Assets

Share:

A significant legal development unfolded in Alberta today as a provincial judge ordered the temporary freezing of up to $8.5 million in assets. The frozen assets belong to Jeffrey Rath, a prominent Alberta separatist lawyer, and his professional corporation, Rath & Company. This drastic measure comes as part of an escalating court fight concerning trust money from a First Nation Treaty settlement.

The order, issued on July 10 by Alberta Court of King's Bench Justice Marion, is an interim Mareva order. It was granted due to reasonable grounds to believe that Rath and his firm might move or dissipate assets before a final court decision can be reached in the dispute with Tallcree First Nation.

Court filings underpinning the injunction allege that Rath withheld crucial financial statements from the trust. It was reportedly through these filings that Tallcree's leadership discovered Rath had charged more than $6 million in 2024. This occurred in the same fiscal year the trust was required to repay the court, leading Tallcree's lawyers to argue that the trust may have effectively financed its own repayment through these substantial charges.

Rath, a co-founder of the Alberta Prosperity Project, is a known figure in the separatist movement and has frequently represented First Nations in various legal matters. The ongoing legal battle highlights complex issues surrounding trust management and the financial responsibilities within First Nation settlements.
